We reserve the right to modify these Terms at any time. When we do, we’ll revise the “Last updated” date above. Your continued use of the Site following any changes constitutes acceptance of the new Terms.

3. Services; Right to Withdraw or Cancel

• Services Provided. We offer email‐newsletter subscriptions and website analytics. We may in the future offer e-commerce or other paid services.
   
• Withdrawal & Cancellation. We may, at our sole discretion, suspend or terminate any service or your access to the Site, with or without notice. If you purchase a paid service, you may cancel according to our Refund Policy (if any), and we reserve the right to cancel or refuse service and issue refunds (or not) in our discretion.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL AGILE CLOTHING COMPANY OR ITS OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (USD 100) OR (B) THE AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS.

You agree to indemnify, defend, and hold harmless Agile Clothing Company and its officers, directors, employees and agents from any and all claims, liabilities, damages, losses or expenses (including attorneys’ fees) arising out of or in any way connected with your breach of these Terms or your use of the Site.

12. Termination
We may terminate or suspend these Terms and your access to the Site at any time, with or without cause or notice. Upon termination, all rights and licenses granted to you will immediately cease.

13. Governing Law & Venue
These Terms and any disputes arising out of or related to them or your use of the Site will be governed by the laws of the State of Arizona, without regard to its conflict-of-law provisions. You agree that venue for any legal action shall be in the state or federal courts located in Maricopa County, Arizona.

14. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Agile Clothing Company regarding the Site and supersede any prior agreements.
